Because the photograph dates from 1865, it has long since passed out of copyright under United States law, and that freedom from any rights claim, combined with the Smithsonian's own high resolution digitization of the print, made it a natural default choice for reference works needing an unencumbered image of Young, which is presumably why Wikipedia adopted it as the lead portrait of its article rather than a later church-produced photograph still carrying a rights claim. 1
